Endo360 Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Endo360 mobile application and related services (collectively, the "Service"). By creating an account, accessing, or using the Service, you agree to these Terms.

If you do not agree to these Terms, do not use the Service.

1. Eligibility and Account Requirements

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are 18 years of age or older.

You must create an account to use the Service. You agree to provide accurate information and to keep your account information up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

2. Description of the Service

Endo360 is a digital health management platform designed to help individuals track and manage endometriosis-related symptoms and wellness information. The Service may include features such as symptom tracking, menstrual cycle logging, educational content, meal and lifestyle tools, AI-assisted insights, a provider directory, and community features.

We may add, change, suspend, or discontinue any part of the Service at any time. Where required by law, we will provide notice of material changes.

3. Critical Medical Disclaimer

ENDO360 DOES NOT PROVIDE MEDICAL ADVICE. The Service is for informational and educational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment.

  • Not a medical device. The Service is not intended to diagnose, treat, cure, or prevent any disease and has not been evaluated or approved by the U.S. Food and Drug Administration (FDA).
  • No doctor-patient relationship. Using the Service does not create a physician-patient relationship between you and Endo360.
  • Emergency use. Do not use the Service for emergencies. If you believe you may have a medical emergency, call 911 immediately.

Always consult a qualified healthcare provider with any questions regarding a medical condition or treatment. Never disregard professional medical advice or delay seeking it because of information in the Service.

4. AI and Machine Learning Features

The Service may offer features that use machine learning or other AI techniques ("AI Features") to identify patterns and generate insights based on information you provide.

AI Features are probabilistic and may be inaccurate, incomplete, or not applicable to your circumstances. AI Features are not medical diagnoses and must not be relied upon as the sole basis for medical decisions.

  • Correlation is not causation. Patterns or correlations do not mean one factor causes another.
  • Individual variation. Your health and symptoms are unique; results may vary significantly between individuals.
  • Bias and limitations. Models may perform differently across different populations and may reflect limitations in the data used to develop them.

5. Privacy and Your Health Data

Your use of the Service is subject to our Privacy Policy and, for certain jurisdictions, our Consumer Health Data Privacy Policy. Those policies describe how we collect, use, disclose, and protect information, including sensitive health information.

You retain ownership of the data you enter into the Service. You grant Endo360 a limited license to host, process, and display your data to operate and improve the Service, including to provide personalized features and insights.

6. Provider Directory

The Service may include a directory of healthcare providers (the "Directory"). The Directory is provided for informational purposes only.

  • No endorsement. Inclusion of a provider in the Directory does not constitute an endorsement, recommendation, warranty, or guarantee regarding that provider, the provider's services, availability, insurance participation, or quality of care.
  • Directory maintenance. We aim to review and update Directory information (such as name, specialty, and contact details) at least every 90 days, but we cannot guarantee the Directory is complete, accurate, or current at all times.

We do not provide credentialing or clinical verification of providers, and you are solely responsible for verifying a provider's credentials, licensure status, and suitability for your needs.

7. Community Forums and User-Generated Content

The Service may offer community features where users can post questions, comments, or other content ("User Content"). User Content may contain personal and sensitive information. Do not post information you do not want to be visible to others.

You are responsible for your User Content and your interactions with other users.

7.1 Prohibited Content and Conduct

  • Posting content that is unlawful, harassing, hateful, or threatening.
  • Impersonating a healthcare professional or claiming medical expertise you do not have.
  • Providing individualized medical advice to other users.
  • Posting instructions for unsafe or dangerous behavior.
  • Posting spam, malware, or malicious links.
  • Posting content that infringes another party's intellectual property or privacy rights.

7.2 Moderation

We may (but are not obligated to) monitor, moderate, remove, or restrict User Content that violates these Terms or that we believe may be harmful health misinformation. We do not guarantee that User Content will be accurate, safe, or reliable.

8. Subscriptions and Payments

The Service may be offered for free or through paid subscriptions. If we introduce paid plans, pricing and billing terms will be presented to you before purchase. Purchases made through the Apple App Store or Google Play are subject to the respective store's terms and policies.

9. Acceptable Use

You agree not to misuse the Service. You will not attempt to interfere with or disrupt the Service, access accounts that are not yours, reverse engineer the Service (except where prohibited by law), or use the Service for illegal activities.

10. Intellectual Property

The Service, including its software, design, text, graphics, and other content (excluding User Content), is owned by Endo360 or its licensors and is protected by intellectual property laws. Subject to these Terms, Endo360 grants you a limited, non-exclusive, non-transferable license to use the Service for your personal, non-commercial use.

11. Third-Party Services and App Stores

The Service may integrate with third-party services (such as Apple Sign-In or Google Sign-In) at your choice. Third-party services are governed by their own terms and privacy policies, and Endo360 is not responsible for third-party services.

If you download the Service from the Apple App Store or Google Play Store, you acknowledge that these Terms are between you and Endo360, not Apple or Google. Apple and Google are third-party beneficiaries of these Terms to the extent applicable.

12. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, ENDO360 DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that the Service will be uninterrupted, error-free, or secure. No system is 100% secure.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ENDO360 WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ENDO360'S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO ENDO360 IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) $100.

Exceptions. Nothing in these Terms limits or excludes liability for: (i) gross negligence, willful misconduct, fraud, or intentional wrongdoing; (ii) statutory rights or remedies that cannot be waived or limited by contract; or (iii) any other liability that cannot be limited under applicable law.

14. Indemnification

You agree to indemnify, defend, and hold harmless Endo360 and its officers, directors, employees, and agents from and against claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any law or rights of a third party.

15. Dispute Resolution and Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

15.1 Informal Resolution First

Before initiating a formal dispute, you agree to contact us at [email protected] to attempt to resolve the issue informally. Please include your name, account email, and a description of the issue. We will attempt to resolve the issue within a reasonable period.

15.2 Binding Arbitration

Except for disputes that qualify for small claims court or disputes seeking injunctive relief for intellectual property or unauthorized access, any dispute or claim arising out of or relating to these Terms or the Service will be resolved by binding arbitration, rather than in court.

Arbitration will be administered by JAMS under its applicable rules. The arbitration will take place in Los Angeles County, California, unless the parties agree otherwise, or it may be conducted by video or telephone where appropriate.

15.3 Class Action Waiver

To the extent permitted by law, you and Endo360 agree that disputes will be resolved only on an individual basis and not as a class, consolidated, or representative action.

15.4 Opt-Out

You may opt out of this arbitration agreement by emailing [email protected] within 30 days of first accepting these Terms with your name, account email, and a clear statement that you wish to opt out of arbitration.

16. Term, Termination, and Account Deletion

These Terms remain in effect while you use the Service. You may delete your account at any time through the in-app settings. We may suspend or terminate your access if you violate these Terms, if required by law, or to protect the Service and other users.

17. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide notice in the app and/or by email. Continued use of the Service after the effective date of the updated Terms means you accept the updated Terms.
